QUESTION: My husband has taken pictures of me while i was sleeping with no clothes on and I also fund a flash drive of us having sex. This was not discussed, I would never agree to any of that and I just happened to find it. I am shocked, hurt and mostly concerned that I don't have all of it. What can i do so these pictures and videos never get into the wrong hands. I would be devastated if my son ever saw these.

I am so sorry to hear about your misfortune. This is a very tough question to answer but I will do my best.

The first issue is that these pictures and or videos may have already gotten into the wrong hands. I seems that these personal memories should not be in your husbands hands and if he has posted these on the internet, it will be very difficult to get them removed. If you know of or find some of your pictures on the internet, you can have an attorney right a cease and desist letter demanding they be removed. Depending on his reason for taking them without a mutual understanding, it may be safe to assume that these pictures and videos have already been posted to some type of adult website. However, short of finding and paying for some expensive face recognition software to scan the internet, your best course of action if to aggressively confront your husband demanding that he tell you why he did it, what he did with them, what he planned to do with them and where other copies (physical or electronic) copies may be located so that he can have them removed immediately.

If you cant control your husband, then you can never be sure where these very personal files may end up!!! It is imperative that you have a serious conversation about your relationship and his fantasies. Because you dont agree with his fantasies, he is doing it behind your back and he probably has a secret lifestyle. If you agree to this behavior, you may find out what he's doing with them and where they are, however you lose your dignity and self respect in the process.

Again, I am so sorry that you have to go through this type of ordeal. I would also recommend some family and individual counseling. I am of the opinion that your husband has some sexual addiction issues and this should not be overlooked but thoroughly addressed if you are to every heal your marriage...

QUESTION: I agree that he is not right for doing this without my consent. I am wondering If I can charge him with anything(invasion of privacy) and If I can request all copies of such materials legally. I have since asked him to leave because even before I discovered this material he was acting  bizarre and very jealous for no reason at all, going through my phone and emails. This leads me to believe he has had an affair. I have done nothing different in our 5 years together but he has changed alot. I am disgusted with his behavior and want to make sure there is something filed with local police in case this is the start of a very bad trend in his future relationships. What if he gets more aggressive? There has to be something I can do.

I am not too familiar with the laws in Canada, but it is my understanding that as an adult you can charge your spouse with certain privacy rights violations provided you have evidence to substantiate your allegations. Nonetheless, it would be wise to speak with an attorney 1st. from this point forward, you should be acquiring any and all evidence to support you allegations as well as to have something documented should he become more aggressive. Once you speak with an attorney, you will be able to determine how best to obtain evidence that can be used against him. Once you have a case filed against him, then your attorney should be able to obtain subpoenas for any applicable records (paper records, IP address info, internet service provider records, digital records, hard drives, etc.) provided they are available and have not been destroyed.
