Question I would like to know what the law states as far as windows and doors in condos? Is it considered to be common property or not?
Answer Erik;
To my knowledge, there is no "law" per se, but that may depend on what state you're in. Most information regarding what is the property and responsibility of the association itself, versus the condo owner, should be found in the association BYLAWS. A deck, for instance, is usually what is called a "limited common element" meaning, it's the condo unit owners to enjoy and use privately (it's not a club house or pool that everyone has access to) but it's maintenance is the responsibility of the association, not the unit owner. I would suggest you read your association bylaws, if your association has a professional property manager, ask them, and lastly, if you simply can't find an answer, consult with a real estate attorney in your state.
Sorry I couldn't give you a more concrete answer. Hopefully someone else on this site did or the information I'm providing is helpful. If there's anything else I can answer for you, feel free to email me again. Good luck!
Kristen
