Question
I live in Chicago Il,and have a Couch House in the rear of a lot, and in the front of the same lot it's a 4 unit building being insured with 2 separated policies, the front one as a 4 units and the rear one as a Couch House bout being insured ,since I bought it(1986) with AllState,in 1989 they send me a notice of non renewal for the Couch House but I appealed with the Illinois Insurance Department, and, at that time the Illinois Ins. Department told Allstate  that they can not cancel my policy, BECAUSE I HAVE BEING INSURED WITH THEM FOR MORE THAN 6 MONTHS. My question is, Can I appeal under the same grounds, because they send me a notice of non renewal for the same property at maturity date and the reason they gave is "Allstate no longer offers this line of insurance in the state of Illinois."

Sincerely Thanks,

Manuel Garcia.

Answer
Mr. Garcia,

It has been 20 years since Allstate made the decision to non-renew your policy.  I must say that it seems a bit curious that you would be concerned about it after all these years.

Having said that, and approaching this as an academic exercise, which I believe is what is going on here, you have failed to mention the type of policy Allstate is claiming to have stopped offering in the State of Illinois.  It would be more likely for Allstate to stop offering Dwelling Fire policies than for them to stop selling Homeowners coverage; so, it may very well be that Allstate had ceased selling the type of policy covering the Coach House, but without specific facts it is impossible to say.  Simply because the company is willing to write the coverage in the past does not necessitate that they continue to do so in the future.

You may contact the Illinois Insurance Department to assist you with any decision made by an insurance company; however, you might be better served, 20 years after the fact, to contact an attorney to discuss your issue with Allstate.  I'm guessing that your chances in getting the Insurance Department to spend time on this case are fairly slim.

Have you contacted ACORN?

Good luck.
