About James R Carrier
Expertise
I'm an insurance adjuster, I'm able to answer questions regarding coverage, damage valuation, or anything to do with property & casualty in the State of Michigan. In other states I can answer general questions but insurance policies are written slightly different depending on insurance law in a particular state. Most questions however I would be able to answer or have the ability to get an answer.

Experience
20 years as a licsensed adjuster, handling 1000's of homeowners claims in Michigan, and Louisiana (Hurricane Katrina).

Education/Credentials
Business degree with an emphasis on accounting from Arizona State University, graduating in the Fall of 1984.

Property & Casualty Insurance - Toielt malfunction

Expert: James R Carrier - 10/22/2009

Question
We just bought a home 2 years ago.  Sunday we were gone all day and we came home the how was flooded.  The toilet had malfunctioned.  We had contractors come out right away to assess the damage and they fixed everything.  Now the insurance company wants us to provide them with a copy of the plumbing repair receipt or description of the plumbing repairs after the leak. I am afraid and do not know what to answer because I want the damages to be covered by the insurance company. Do you know what is typically covered and what is not?  My plumber told us that it was a toilet malfunction and we just told him to replace the toilet with a new one.  We are in the state of California.
Thank You

Answer
Brenda,

The toilet itself is not covered, however the resulting damage is covered. In this case the truth will set you free. It is impossible to get the toilet covered, unless a covered peril happened to the toilet that caused it to break. A covered peril would be a fire, a tornado some kind of occurrence and that just didn't happen, nor could you convince someone it did. Now the damage caused by the toilet malfunctioning is covered so get your contractor to write it up with that in mind. I've explained it pretty well let your plumber read this so he can show them a bill with what is covered in mind.

Good Luck,
Jim C
