Property & Casualty Insurance - Toilet malfunction

Expert: Jay K. Williams, AAI, AIP, CIC, CRM - 10/22/2009

Question
We just bought a home 2 years ago.  Sunday we were gone all day and we came home the how was flooded.  The toilet had malfunctioned.  We had contractors come out right away to assess the damage and they fixed everything.  Now the insurance company wants us to provide them with a copy of the plumbing repair receipt or description of the plumbing repairs after the leak. I am afraid and do not know what to answer because I want the damages to be covered by the insurance company. Do you know what is typically covered and what is not?  My plumber told us that it was a toilet malfunction and we just told him to replace the toilet with a new one.
Thank You

Answer
Hi Brenda,

This is typically a covered loss.  Normally, it's a malfunction of the parts inside the tank.  The company should pay for the resulting damage, but not the malfunctioning parts.  You should understand that the payment from the insurance company is subject to your policy's deductible. Unless the toilet was actually damaged, it is not something that would usually be replaced.

You should provide your company with the information they are asking for.  It is information they need to pay the claim and to document the loss.

I hope that helps.

Let me know if you have more questions.
