Property & Casualty Insurance - toilet malfunction insurance claim

Expert: Thom Brooks - 10/22/2009

Question
We just bought a home 2 years ago.  Sunday we were gone all day and we came home the how was flooded.  The toilet had malfunctioned.  We had contractors come out right away to assess the damage and they fixed everything.  Now the insurance company wants us to provide them with a copy of the plumbing repair receipt or description of the plumbing repairs after the leak. I am afraid and do not know what to answer because I want the damages to be covered by the insurance company. Do you know what is typically covered and what is not?  My plumber told us that it was a toilet malfunction and we just told him to replace the toilet with a new one.
Thank You

Answer
Brenda, hello!

Every claim is looked at differently, even if you submit that identical claim to the same company in the same week.  The Insurer will want to know if it was Negligence on your part, or a product defect.

Without knowing the details, the company would likely state that you have to pay your deductible but they would not be obligated to replace an entire toilet.  They would pay for damages caused, if it is Sudden and Accidental damage, but it is your responsiblity to keep up with routine wear and tear, and normal replacement.

If the company didn't authorize the entire toilet to be replaced, that would likely be your at your expense.

Take care,

Thom Brooks
