Property & Casualty Insurance - Auto Insurance

Expert: Jay K. Williams, AAI, AIP, CIC, CRM - 6/18/2009

Question
My son was driving my car and was in a car accident where the other party received a ticket for unsafe movement; he received a ticket for no operators license. His license was valid, just didn't have it on him that night. However, my insurance had lapsed.  The other parties insurance adjuster is now claiming the accident is my fault and has placed a collections claim against me for their policy holder's auto.  Am I liable for their vehicle if the police officer even said it was their fault? I fixed my auto out of my pocket.

Answer
Hi Kathy,

Sounds like a feeble attempt by the other insurance company to scare you into accepting blame for the accident. Given you description of the accident and the charges filed, you should NOT be held liable for the accident AND the other insurance company should be paying to fix your car.

Let me know if you have any additional questions.
