Property & Casualty Insurance - trees falling on property

Expert: Thom Brooks - 6/21/2009

Question
I live in Kentucky and during a recent storm one of my trees have fallen onto my neighbors property damaging his chain link fence. He is not in town at the moment. Who's responsible for this and what do i need to do?

Answer
Stacy, call your Insurer.  Your company will advise.  If it fell due to an Act of God, and if your tree was not rotted, then your neighbor will have to pay their deductible and then their insurer will pay the claim.  If you were negligent, they will subrogate back to you.

Take care,

Thom Brooks
