Property & Casualty Insurance - Street worker

Expert: Hal McFarland, CIC, ARM - 8/19/2009

Question
I need to get my roof tarred. If I hire an off the street man and he gets hurt while doing the job, does Home ownwers Ins. cover him?

Answer
Goldie,

That pretty much depends on the state within which you are located (workers' compensation law) and the coverage and/or exclusion wording in your homeowner's policy.

You may want to consult an attorney to draft an Independent Contractor Agreement and give your homeowner's insurance company agent a call to discuss coverage/exclusions.

Your potential out-of-pocket loss is great.  Generally, not a good idea to hire jackleg contractors.  Better to pay seasoned, experienced contractors with insurance in place.

Good luck!

Hal
