Question
I was the #3 car in a car accident. I was at a red light going south when vehicle #1 ran his red light going north and hit car#2 so hard that car #2 spun into me. Its been almost 2 weeks and vehicle #1 insurance has not accepted liability. Why is it taking so long. I went to my doctor the next morning stiff and in pain. I am on pain meds, ice pack, heat packs and am not able to have play time with children. What is my pain and suffering worth?

Hi Betsy,
Before accepting liability, the adverse company needs a copy of the police report, an
on scene investigation and most importantly, a report from the person who was driving
what you refer to as vehicle 1, and then determine (if that party is not a named driver
on the policy) if they legally owe coverage to the person that was driving.

As far as the value of your pain and suffering is concerned, that is something that you
can discuss after you have completely healed.  The major factors will be your economic
losses such as medical bills and lost wages.  Using an ice pack and heating pad every
day for 6 months has no value because there were no medical bills.
