Question I have turned in a claim for a ring and watch to lib mutual. It was turned in 4-9-09. I have given them a statement under oath. They ask for bank records since I have no receipts. They have called the person that I bought the watch from. The ring was purchased in NY. The attorney for the insurance co. is also asking for phone records the day of the loss. Do I have to give them phone records? They are saying that they cannot complete the investigation until I do so. What are my rights. They have been delaying my claim for over 4 months it took them 60 days to call and verify that I bought the watch and to call the golf course where I lost these items. I need your advice. Thank you.
Answer Hi Votie,
Some companies will go to great lengths to delay and/or deny a claim. Some key word
or happening during the initial investigation has caused Liberty Mutual to feel that
this is a fraudulent claim.
When they first felt possible fraud, they assigned your file to their Special Investigation
Unit (SIU). SIU made the demand for a statement under oath and all the other parts of
the investigation that are beyond normal.
Once your file has been assigned to SIU, there is virtually no limit to the amount of
time that they can withhold payment. They are more interested in finding you guilty
of fraud and being able to arrest you when they finally give you a check than making
payment to you.
I certainly hope that someone advised you to hire and take an attorney to the statement
under oath (SUO). Each and every question ask of you at a SUO hearing should only be
answered after approval from your attorney.
I suggest that you file a complaint with your state department of insurance. They may
be able to intervene and speed things up a bit.
