Question My mother in law died and left a house. One of the requirement for the "declaratoria de herederos" is the marriage cerficate, but my mother in law was separated from her husband (for over 10 year) when she built the house in puerto rico. Does she still need the marriage certificate?
Answer Hola, Myrne.
Your question is really for your lawyer, but as you are asking for my point of view, I think that, if your mother in law was not divorced, you would be required to submit her marriage certificate. Although she was separated from her husband for so many years, it was necessary for her to get a divorce. Even in the case that she would have gotten the divorce, then you would be required to submit the corresponding Court's sentence.
It is my pleasure to be of help.
Saludos desde Puerto Rico, :)
