Question hi,thank you for your time.In the town of Aguadilla, many decades ago , my father had a home built for his parents on their land, where he and his siblings were born and raised.This was to replace the original home (that was falling apart).This was a promise he had made to them upon leaving to work in New York and starting his own family. Today, many decades later, both his parents and,he, have died. Since then, some of his nephews have built homes for themselves on surrounding land ( which is all family owned through the generations). Everyone there knows that this parcel of land is rightfully his through inheritance, and as such no one has built on it. I had the old home my father built ,demolished ,due to it being an eyesore and placed a chain link fence around the property, to prevent it from becoming a dumping ground. His wife for life, who is my mother would like to either build on it or sell this land, but has no paperwork giving her the right to claim ownership.My deceased father is survived by two sisters who have built their homes elsewhere in the town.QUESTION: how does my mother gain rightful ownership of this parcel of land that my father left her( although he signed no legal documents saying so).There is no deed, or so she is being told by relatives.She would also like to be able to gift it to one of her daughters while she is alive, she is 77 years old, so time is an issue. This should have been taken care of years ago, but it wasn't, so here we are today. Your mother needs to work in what we call an "Expediente de Dominio". I noticed that you are well aware of the history regarding the ownership of the land, so I think you will have all the information needed, so that she can register the property under her name. After that, she will be able to work in an "Escritura de Donación", transferring the ownership to her daughter.
The preparation of the mentioned documents require patience, time and money. She needs a lawyer to be able to prepare all the legal documentation.
