Rape Counseling - Rape Kits

Expert: Kelli - 6/18/2009

Question
NCIS will not tell me the results of my rape kit. They've also declined to tell me where it went. I need to know what the federal law or NCIS does with there rape kits.

Answer
I am so sorry, Jessica, but I do not know.

Usually, in civilian cases, rape kits are kept on file with the local police department.  The DNA that is obtained can then be processed to find if the perpetrator is already in the database.  The pictures, the blood work, the DNA samples, and other results are kept on file for prosecution.
Because of that, I would think that your rape kit is on file.
However, if it has been lost, I wonder if the hospital kept any type of record or if they ran their own lab tests. I would ask. Since it's your hospital record, you should be able to request copies of their files.  There is usually a simple form to fill out and ask for everything-- doctor's notes, nursing notes, copies of any lab results or any Xrays or whatever may have been taken.

Other than that, I don't know what they are required to tell you by law.  If they found a DNA match for the perpetrator or not. I don't know what they are required to tell you as far as the investigation.  I am also unclear about where you can go from here- are you able to obtain outside counsel that can assist you?  Sounds like you may need to find a professional that can help you with all of the legal requirements and barriers regarding NCIS.

I am sorry I cannot help you more.
Good luck to you,
