Expert: Bill Iannelli Date: 6/17/2008 Subject: right of way or easement
Question Do I have to go give my new neighor the right of way or an easement to his property which I know is landlocked?
if so can I charge him for the use of my property? They want to build about 40 homes. there is another road that borders his land.
Answer The best place to go would be the planning and zoning department where the land is located. They will be able to tell you much more that I can in this situation. Usually there is no law forcing you to give an easement, especially if there is another potential entrance. People can sell the right to an easement or sell a portion
of the land to him for an easement. Again, this will depend on planning and zoning regulations. They will be able to tell you everything you need to know. It would be wise to go there in person and write down the date, time and name of who you spoke with.
