Subject: Real Estate transfer when one dies

Question
I have a customer who owns property with his spouse in Florida.  His spouse died in 2000. Which form do I use to transfer ownership to him as a sole individual?  Current title does not reflect owners as being tenants in common or survivorship marital property.  It just states the names of the husband and deceased wife.

Answer
Dear Heather,

First there needs to be made a determination if the property was a homestead or not.

Second, after the determination, I would suggest that your customer consult with a Florida real estate attorney, as the property might have to pass through probate and there could be some taxes involved prior to the title being able to be transferred.

This is save your customer much aggravation in the future should he decide to sell property in the future.

The process if not handled properly can take months to resolve.
