Question Under Florida law is a commission due a prior listing agent if a home, seen during the contract period of that agent by a potential customer, is sold after the original listing ends to the same customer by a different agent who then has the listing and gets the commission as the selling agent? Isn't the point that some agent gets a listing commission to prevent collusion by buyer and seller when a listing agreement ends?

Answer Tom,
This issue isn't addressed by Florida law, but but it is all covered by the listing contract between the broker and the seller. Most listing contracts have a protection period during which a commission is owed to the original list agent if his buyer purchases the property after the listing ends. But if the home is subsequently re-listed with another agent, then usually that agent gets any commission for selling the property, unless the original agent has a buyer/brokers agreement with the buyer.
