Question
Hello,

I have a mortgage, where when the co-owner passes, his ownership passes to the living co-owner.  I can't remember what this is called.  Do you know?  Also, since ownership passes to the surviving co-owner, wouldn't this avoid one having to go through probate?

Answer
Hi kee,

The type of ownership you are speaking about is called a Joint Tenant agreement. In this agreement two primary owners each own 50% of the property and have the right to the other 50% if one should pass away. Technically, you would not need a Will or Trust to pass the surviving ownership of the property to the other rightful owner. However, in the case that someone owns a house and has money to pass on to heirs, I always recommend a Will or Trust just in case. Speak to an appropriate lawyer to set that up.
