Question
I was still carrying my ex husband name at the time I purchased my home so that is the name that the deed is recorded.  I have since went back to my maiden name and would like to know if I can have my mortgage loan in one name and the deed in another last name?  I am getting conflicting answers.

Hi Amanda

The deed can have different names than the loan, the deed is who has interest in the property the actual mortgage is the responsibility to pay back the loan.  If you do refinance whomever is on the deed does have to sign the mortgage (or deed of trust, depending on your state) to acknowledge that there is a lien on the property that they have interest in.  I hope this helps you.
