Topic: Real Estate Law (esp. Landlord-Tenant)

Expert: Jonathan Dever, Esq
Date: 6/24/2008
Subject: ex live in girlfriend claims she has legal rights to my property

Question
My ex girlfriend has lived with me for the past 4 years.  3 years ago I bought my house and I own 90% of the property inside.  I am trying to get rid of this woman, and one of the things she is throwing at me is she has legal rights to my property because she has been living with me for "X" amount of time.  We are not common law married according to Kansas Law, so that should not be an issue.  I'm concerned if I start getting more aggressive trying to remove her from my house that she will take me to court.

Answer
Unless there is a palimony statute in your state, or some common law right to personal property, she is only entitled to what is hers or what you bought together.  Did you keep your money and hers separated?  Did you have children together?  Best thing to do is find the top divorce lawyer in your area, pay for the hour consult, and find out what she could do to you in your state.
