Subject: tenant breaking lease

Question
Tenant moved in & after 5 days started complaining about doors, dehumidifer noise etc, he asked to break lease, we agreed he could move out but we would keep security.  He stopped payment on rent check & said to use his security check. 15 days later in response to letter about stop payment he is saying house has mold (we are unaware of mold & were never given time to check it out). He says he has moved (not returned keys) & wants us to pay him to move. What do we do?

Answer
What do you want to do?  You have a signed lease agreement yes?  Do you want to enforce it?  You are in the driver's seat here, even though you may not feel like it right now.  If you can honestly answer the first question, then the rest is simple.  :)
