Topic: Real Estate Law (esp. Landlord-Tenant)

Expert: Jonathan Dever, Esq
Date: 7/20/2008
Subject: Carpet Cleaning in Rental Apartment and "Normal Wear and Tear"

Question
When we did our final walkthrough with the lanlord, she stated that a certian area of the carpet may require a charge for extra cleaning.  The area in question is directly in front of the patio door, which became stained from the daily opening and closing of the door (the bottom of the door was brusing up against the carpet).  Is this considered to be normal wear and tear?

Answer
I can't really help you one this one.  Normal wear and tear is an animal of fact and local jurisprudence.  Take pictures and do walk throughs before and after you move in/out.  All I can say is that it is a matter of fact and a he said she said game if there is no documentation and/or agreement as to what is normal given the circumstances.
