Subject: Home Theft with Lock Box

Question
Our home is up for sale and has a lock box. We have complained to the realtor that things have come up missing, i.e. a Queen size feather mattress for one, and personal areas rummaged through. Her response was,"there is nothing I can do about it, it's a he said she said thing." She never returned any of the police calls for information about the box list access. Now more things have been stolen to the point of over $500.00. Is this person responsible to try to protect our home or not? She has just totally ignore the problem. I want to take her to small claims court, but want to be sure I have a leg to stand on.

PS I have a police case number already started

Answer
Call the police again and file a police report.  Then call the Board of Realtors and lodge a formal complaint.  If that does not work, file a suit in court and subpoena the records, and sue each and every person that came into the house. Depose each and every one of them.
