Real Estate Law (esp. Landlord-Tenant) - Insect infection- Who's responsible???

Expert: Jonathan Dever, Esq - 7/29/2008

Question
Hi,

I hope you are having a good day!
I am not fully aware of our (tenants) and our landlords responsibilities. We are sufferig from bedbugs for a while, and we contacted our landlord to let him now what is happening. For the first time there was no problem, he gave us a job reference number, and said, he is going to sort it out. Then he sent us a text message that due to the fact that we are AST tenants, we need to take care of it. The third time we talked to him, he said the infection started later than we moved in, so we caused it, we are responsible for it... I don't know whether he want to save money on us, or it is our responsibilty.
Thank you for reading my email, and I look forward to hear from you!

Kind regards,

Beatrix Kovacs

Answer
Keep records!  This is a huge and growing problem.  the issues of responsibility and damages to your property are real, and differ from state to state.  The best thing to do is call a local attorney and see if they have had experience dealing with this issue in your jurisdiction.
