Question
I have been living in a rent stabalized building for close to 3 years in NYC. I live with a roomate, and the lease is in his name. Ten months ago I purchased a puppy (german sheperd weighs about 80 lbs now). My lease states that I cannot have dogs. There are about five tenants with dogs (small) in the building. I asked the super, and the doorman if it was ok to get the dog, and they said it was, but to just use the basement entrance. A new tenant moved in below me, and has threatened to call the police, and sue me. She is pregnant and is saying the noise is stressing her during her pregnancy, and if something happens to her I can expect a law suit. She has gone aorudn to my neighbors to see if they agree the dog is noisey, and they all say no. He rarly barks, but does run around in the apartment at times(my roomate gets him crazy when I am not there, and knows to stop now). I have put down throw rugs, and threw out all of his heavy toys. I am trying to work with them. The super and doorman have told me that she is crazy and is complaining over nothing about lots of other issues(Issues no one has complained about in the 30 years the doorman has been workign there) in the building. I do not want to see anything happen to her while she is pregnant, but I love my dog also, and truly feel she is being ridiculous in regards too how much noise he makes. I recieved a letter last week from the landlord stating that the dog must be evicted from the premises. Due to the recent housing market slump I lost my job, and I have had troubles financially. The rent has been paid late, and we have been behind at points. Our lease is up in two months. Can the police really come and take the dog? Can they put a dead bolt on our door, and not allow us in? Can they evict us imediatley, and can they not extend a new lease to us in the two months? Can she really sue me god forbid something happens to her?

Answer
she is full of it.  she is stressed cause you have a dog?  give me a break.  The only issue you might have is that you got a dog without written permission from the landlord.  Unless you dog attacks her, she can't just sue you.  That would be like saying she hates the color blue, and she wants to sue you cause you wear blue and it will stress her out and cause her unborn trauma.
