Question I was just served with a paper stating I am a creditor to my landlord and they are filing bankruptcy, what does this mean? Should I be finding a new place to live? I had given him 2 months deposit and first months rent, I just signed another years lease 2 months ago, I feel like I will not get my deposits back if they have listed me as a creditor. What protection do I have and how long will I have to stay here? Should I continue to pay the landlord rent?
Answer First, take a deep breath. Second do not panic.
If the landlord has filed bankruptcy, you will be served with a notice of stay. You might want to seek out a local bankruptcy attorney and have them review the documents served. You may need to file a proof of claim to secure your rights to the deposit funds.
