Question
We have a lease for another 6 months (yearly lease).  We bought a house recently and need to terminate the lease.  I am willing to pay the remainder of the rent in advance to the landlord.  However, FL law states that if the property is relet the landlord is required to only keep the difference between the rents.  If I pay the entire amount of rent in advance and terminate the lease will I be losing my right to a claim if the landlord relets the house?  Is there any specific language I should use to ensure my rights are not forfeited?  

Once the lease agreement is terminated will I be liable for maintenance of the property until it is relet or the end of the lease term is reached?

Hi Victor:

I am not familiar with FL law (as my profile states I'm only a professional in WI) so keep that in mind.

However, based on what you told me the landlord would be required to refund any money back to you for money they collect in re-renting the premises.

As far as the maintenance goes...I have no idea as that is not something we ever deal with in WI.

It's probably best to talk it out with your landlords. If you pay them in advance, I am sure they would be willing to work with you.

Make sure to put any and all agreements in writing. It's always best that way.
