Question
I have rented an apartment that comes with two parking spots and I have my car and my truck in those designated places, but my landlord says he/Dept of Health is going to tow my truck - his first excuse was that it is disabled (I proved that it is not), then he said it wasn't registered (I can prove otherwise), and finally he said it is an "eyesore," and this is the crux of the matter. Can he remove my truck for this reason, or any reason if it is parked in the correct spot and runs?

Hi Greg:

To answer your question you will probably have to look at whatever you signed that relates to the parking spot. However, based on what you've said it sounds as though maybe nothing is in the agreement about "eyesores" and therefore that is why he's giving you other reasons as to why he wants it removed.

If there is nothing in the agreement, and there probably isn't, then I can't see how he could have your vehicle removed if you are in the designated spot.
