Real Estate Law (esp. Landlord-Tenant) - Landlord filed bankruptcy

Expert: Michelle Mangen - 4/25/2009

Question
We are in a 1 year lease (Indiana) and just found out our landlord is filing bankruptcy. He stated that we have to vacate the home so he can convince the court that this is his primary residence.  Our lease states it can only be terminated for non-compliance on our part. Our rent has never been late and the home has been well maintained by us. What are our rights?

Answer
Charlotte:

That sounds like a touchy situation. It does not sound as though you did anything that would mean he could terminate the lease. So you have the right to stay.

From what you've told me it sounds as though if you decide to vacate it will be to help your landlord out.

Probably best to come up with a plan of action with him.
