Question
I am currently married, seeking divorce.  I am out of the state of WI, I am in Arkansas.  Although I left my husband about two months he has now moved from the property that we had a residential lease/ rental agreement and this agreement started in his name and his fathers name.  Although now it is only in my soon to be ex-husbands name.  He is trying to put half of Aprils house payment on me and telling the landlord it is my responsibility when again my name is no where on the lease.  Can I be held responsible for this unpaid amount?

Hi Ariel:

If I understand correctly the lease is in only your ex's name, correct?

If so, what was the effective date of this change in the lease?

If it was prior to April 1st then I would believe that the liability is 100% his and that you cannot be held liable.
