Real Estate Law (esp. Landlord-Tenant) - Breaking a lease before you move in & money changes hands

Expert: Michelle Mangen - 5/26/2009

Question
Hello Michelle,

I signed a lease in the name of my insurance company for a home we were going to rent.  The lease is in the name of the company with my signature.
The owner asked us to make a fake secondary lease with different terms so she could submit it to her Strata Council, as the terms of the real lease are not conforming to the rules & regulations of the development.

We felt uncomfortable and cancelled the lease 2 weeks after we signed.
No money has changed hands at this point.
The landlord is threatening to take legal action if we don't pay her the rent by the first of the coming month.

Is the lease valid if it goes against the rental rules of the development?
Does the fact that we were asked to supply a false lease to misrepresent the terms of our lease have any impact?

Thank you for any advice you can give.

Answer
Zoi:

As my profile indicates I am only familiar with WI Law.

I think with the scenario you described it's probably best you get an attorney.

I'm hoping you have both copies of the lease so you can prove that they asked you to sign a different copy.

I think that the false lease is very important in all of this.
