Real Estate Law (esp. Landlord-Tenant) - Music Lessons in Basement

Expert: Michelle Mangen - 5/4/2009

Question
Hi there,
Im from Canada but Im sure this question is a common sense one across borders. I just moved into a basement suite, and seem to have a very decent landlord. I mentioned to him before I signed the lease that Id like to teach a couple of music lessons a week in the suite Im renting, and he made no objection. They would be in the afternoon or evening, playing rather softly on violins, and I cant foresee any trouble, and Im just about to make sure hes alright with this arrangement. I wanted to ask you, am I ok here? If I rent a basement suite theres nothing against teaching lessons and earning money in it? Furthermore, on the small chance he says no, would he have any grounds?
Thanks so much

Answer
Hi James:

If he said he was OK with it then it sounds as though there should not be a problem. However, I would advise that you get it in writing. The reason I suggest that is, what if he sells the building and then the new owner does not want it to happen.

It's not uncommon, in WI, to have landlords say that things of that nature cannot be done in the apartment. And, they can enforce that.

So if your landlord says yes, yippee for you! Just do what you can to get it in writing.
