Question
My landlord only partially refunded my deposit after 3 months of vacating the
premises. He had initially issued two checks for me reflecting the full deposit
amount, but asked me to wait before cashing them until he had money in the
bank. I was able to cash the first one (for about half my deposit) after 3
weeks, and after another week or so, he gave me $100.00 cash and new
check with the remaining deposit balance ($250.00), which he asked me to
wait before I deposit. Well, it has now been over two months and he claims
that he has had health problems and have not been able to put money in the
bank for me to deposit the last check. I was quite patient with him, but I am
now over it.

If I file a small claims against him, can I ask for interest ? (I live in CA) ? UP to
how much? Any help regarding this issue would be welcomed. Thank you.

Hi Vartan:

I'm not very sure how things like this work in CA.

However, the small claims court would be able to answer your question. They can't give you legal advice but they can tell you guidelines and if they don't know make sure you ask the commissioner/judge when you are in court.

In WI interest is 12% APR.
