Real Estate Law (esp. Landlord-Tenant) - roomate move out without turning in the 30 days notice then disappeared

Expert: Michelle Mangen - 5/21/2009

Question
I want to move out of my apartment. When we first moved in, we had 3 people signing the lease (my co-signer, my roommate and I).However, my roommate moved out without signing the 30 days notice. Now I want to move out, and the manager asked all of us to sign. The problem is I cannot get my roommate to sign since we don't see each others anymore. What is going to happen to us? Does my aunt have to be responsible for all this?

Answer
Julie:

I am not sure where you are located however most likely your roommate does NOT have to sign in order for the notice to vacate to be valid.

In WI they are not all required to sign.

Talk to your landlord and let them know what happened and explain that is why he/she is not signing.
