Real Estate Law (esp. Landlord-Tenant) - carpet replacement

Expert: Michelle Mangen - 6/6/2009

Question
I moved into a 2 bedroom apt. in Phx, Az and in one of the rooms we are missing a good chunk of carpet. Just as there are a few big stains on the floor. The people who lived here before us owned a mini dog. I am wondering if it is a requirment for health issues if the carpet has to be replaced by the landlord? I am 6 months pregnant and i really want the carpet replaced but can't afford it. Shouldn't the landlord pay for it?

Answer
Hi Stormi:

I'm not sure if Phoenix has "health issues" for carpeting. I know that Wisconsin does not.

Ask the landlord and see what they can or will not do for you. Often landlords hate to try to replace carpet in an occupied apartment because it's very difficult to do and costly as it typically cannot be done all at one time.

But talk to them, you may be able to get them to do something about it.
