Question Hi larry
I am looking to invest some money in real estate with a friend. This is a cash only transaction and my wife and I are planning to lend part of the purchase price to the partnership and contribute a portion as investment from myself as an investor. Questions I have are
1) How can we record and perfect a lien against this investment property for the amount of the loan we are providing
2) Would it be advisable from a legal standpoint to make my wife be the lender on her own as I am one of the investors as well? Strictly looking at it from enforceability of the above lien against any other unforeseen liabilities/claims against the property.
Your response will be highly appreciated
Answer You need to discuss this transaction with a good title attorney. Its somewhat complex and must be titled and recorded properly as to lien holders and ownership tenancy rights. I suggest you contact Jill Michaels,ESQ at 240 425 0011. or jill@jillmichaelslaw.com. Good luck.
