Question
Mu husband had a very expensive auto repossessed.  Ford sold it and the sale still left my husband with a balance of 33,000.  Ford's lawyers filed a lis pendens on our home, however no judgement was ever ordered.  We did not know that a lis pendens was filed against us, and when we went to sell our home, a title search showed that we had a lean on the home. The lean was with Ford's lawyers.  Ford's lawyers lied to the title people and told them that there was a judgement against the property.  The title company withheld 50,000 of out equity, until the lawyers released it.  Months passed and there was never a judgement issued. I filed a petition with the county court, and that is when I learned that there was never a judgement issued on the lis pendens.  Still the only way the lawyers would release our equity money, was for us to settle out of court with them.  Was this extortion?  Can we sue the lawyers and the title people for this?

Answer
You need to contact an Real estate attorney.
It sounds like you could have not paid, but may be to late since you settled.
The title company job is to clear the title, including having you settle with Ford.  However, they should have known there was no judgement with the title search.
