Question
We have received a letter regarding the cancellation of our lease as of MAY 31, 2009.
(we broke the lease, and management agreed, so we have received a letter of cancellation of our lease)


We have agreed to pay the whole month of May's rent, because we understood we needed to give one month notice prior to the moving date of May 31st, 2009.

But we were surprised by the letter saying we need to vacate no later than May 25, 2009.

As long as we pay whole month of May, we think we have a right to be here by May 31st.
If they want us to leave by May 25, 2009, due to the next tenant moving date or anything else, then I think they need to pay us back for the rent of May 25-31st.

I undrestand your concern, and want to let you know, your side of the party is the side that broke the lease.

It's very nice of the managment to allow you to move with out monetary damages. They can easily go to court and win the case, because their lease agreement was breached, and you end up paying alot more than what you want BACK.

Do undrestand in normal circumstances you are 100% right with your calculation, but in this case, just go ahead, and move. 5 days diffrence is not much anyway, and also, if you want you can actually start moving by the 25th and by 31 the apartment has to be empty.
the notice is a general letter.

so good luck to you, and if you really want to move, don't worry about the 5 days.
