Real Estate: New York - judgements at closing

Expert: Reza Ardebili - 5/15/2009

Question
I'm in New Jersey and on my credit report I remember seeing a child support judgement and a couple of credit card judgements...I'm selling my house  and at closing will I be forced to pay these with the proceeds of my house ???

Answer
I don't think you have to pay these judgments. I know if you were purchasing, the bank would have wanted you to pay those, but because you are selling, i don't think you are FORCED to pay at closing.

But if they have judgment, they can levy your pay check or put lien on your belongings.

But do please ask this question from a lawyer, and let us know also,.

As far as I know, nothing get deducted from the proceeding.
