I represent about 30 members of a community garden operated by an 80 year
old membership corporation that takes care of about 3 acres of park property
in NYC. This property was left largely undeveloped on its northern border,
which backs up into a rail line, until about 1970. Then, members of the
community reclaimed an irregularly shaped parcel and established a
community garden. Real estate interests now want to build housing nearby
and it would bolster the price of their holdings if the road, which curves
around this garden, were developed further. About a month ago the city sent
surveyers to draw lines. They go right down the middle of this property. Do
we have any recourse, given we asked the city to improve the road many
times ourselves but it was not profitable for them until now.
Answer Hi, thans for the question!
Even though this should be in a legal forume part of the website, but i can give you couple of incidents, i have ahad before.
Builders pay for this procedure to be done by the city, and city loves to make money. So even though you have took over, and made it to a park/garden... it's NOT your property. eaither city property or developers property in no way is considers yours.
I appoligize to tell you this, but other than working out some type of deal with them, you can not, get anything from this.
You have to eaither purchase that lot, or get a 99 years lease from them.
