Question QUESTION: We signed with our realtor for 1 year. After 4 months, he has not brought anyone through the house. He has made promises that have not be kept,open houses,advertising etc... His only answer is to lower the price. We are currently priced below apprasial. Can you withdrawl/cancel the contract. So far he will not agree to this. We are willing to pay him for any advertising he has done thus far.
ANSWER: You should be able to speak with the agents broker - the listing agreement is between you and the listing company, the agent can be replaced at your request. I would bring up all the issues but I would not offer to pay them for anything. The broker should bend over backward for you but let me know if this is not the case and I can find out from my broker how you should proceed. There may be an "out" in the contract but hopefully a better agent can pull you through! So just call the office # and ask for the broker of the office, or request a meeting in person with them. QUESTION: The realtor is the agent/owner of his own realty company. If you signed a one year contract is that binding no matter what?
Answer My broker said:
He needs to ask. If the broker won't let him out of the agreement there is little he can do....other than bump the price up about a million dollars and be completely unreasonable so the broker wants to fire him!
Or I am thinking you could make up an excuse for unlisting/withdrawling the home from the market, say that you have just been promoted or something. You can call me, or my broker, with your listing agreement in front you if you want to talk about the protection period clause that is in your "exclusive right to sell" which would outline how you can legally proceed to sell your home.
