Question Good afternoon... This is hard to explain, but I will do my best. We have a cabin at Leesville Lake. We have a spring fed gravity water system. The spring is not located on my property. The spring feeds a cistern at the source (it is a clay pipe) This feeds water pipe that goes down an abandoned road and feeds three cabins. This "water sharing" has been going on for decades. Well one day my water stopped and through investigation (digging), I found that my neighbor cut the line and remove the tee fitting that tied my line to water source and put in an elbow fitting directing all of the water to his cabin. I am researching whether the water line even crosses his property. Does he have the right to remove me from the water line? (The previous owner of our cabin had repaired/replaced the water line a number of years ago - the water line is nothing more than black plastic pipe) Please let me know what you think. I am going to the County Courthouse on Thursday to see if I can verify approximate property lines. Thanks
Answer Hi Mike
Sorry for the delay. I think that your neighbor cannot legally take away the access for you to have water. I assume the courthouse suggested the authorities or a lawyer step in. Or are they able to handle it through a different manner? Keep me posted if you have the time!
Good luck and let me know if you have any other questions!
