QUESTION: Hi,

A water supply line for a third house is running between my and my neighbor's property, mostly on his.  At the point this line requires replacement, what are our rights?  This is an old line in Milford (Clermont Co) and the neighbor was told by (the easement authorities) that there is no easement on file for that water line.

I am not an expert on easements but I will forward this to my office to see if anyone has come across this yet.  What has the city said?

QUESTION: Thanks for the reply.  The neighbor worked with three agencies and after some digging, someone found an easement afterall.  The water department did not know about it, but another agency did, so that is a mystery to them.  We haven't yet seen the description of the easement.  We are concerned about restoration of our properties after the new dig (thursday), since past repairs of the line have not been repaired by the owner of the line.  We are hoping the easement might mention something about fixing the land after the dig.  You don't have to pursue this on my account now because an easement has surfaced, but it might be interesting to know the answer to the original question too.

This is what I rec'd-

Amanda:  My experience with easements are that Milford, or whomever, will do the repair on the easement and attempt to return the dirt/area to normal  (i.e. seed and straw).  Call the City of Milford Public Works for help.

I hope this helps.  If there is an easement on record, and their are plants, fence, etc in the way, it is (Milford's) or the right of the county,city to do what it takes to remedy the situation, i.e. in the water line.
