Question
I am in the prosses of purchasing my first home. I had a Radon test done, and the level of radon was above EPA standards. I am asking the seller to fix the problem. I was wondering since the level is high (11.4) is he legally obligated to fix it, or can he say no.

I do not think he is legally obligated by the EPA to fix it (I'd have to check) but now that he is aware of the problem he cannot hide it (per OH mandated disclosures) from any future buyer(s) which means he has to fix it one way or another, he is not going to be able to sell it without someone wanting him to fix it.  I would say his agent would recommend he fix it and your agent should demand he fix it.  This is not a small issue that can be swept under the rug and ignored.
