Question We own a vacation home on Lake Murray, SC. We need to do some major landscaping on the side yard near the highway. This yard is limited in square footage because the house is very large and spread out. There is a utility pole on the edge of the roadway with 3 guide wires or tie downs that stretch into our parking area. I spoke with the utility company and requested they remove them or put them closer to a fence dividing two properties. The safety engineer looked at the guidewires and said they could not move them. They also said that one of the wires belong to a cable company or a telephone company. We dont have cable or a land phone at this residence. What rights do we have as to how much land can be used for these type utilities? How can we find out what our rights are? These wires reduce the value of our property. We are considering selling this property and would like to get this cleared up.
Answer Good afternoon Linda,
I forwarded your email to Andy aun, the real estate attorney. I have pasted his answer below:
Christy:
You need to have them pull a copy of their most recent survey to see if this is shown on the property. If it is not, they should have a new survey done to describe what is on the property so that they can know what rights they have and don't have.
Andy
If you have the survey, you can contact Andy for more information. His email is andy@aunmckaylaw.com.
I hope this is helpful!
With best regards,
