Question Hello there my name is jon i'm tring to sell my mobile home but the title was lost and the dmv keeps telling me that there is no title in SC for it. But i pay property taxes on it. Can i sell it just on a bill of sale? What can i do?
Answer Make sure you covered all your bases in searching for your title. Was or is there a lien on the home? If so, the bank may still be holding the title. Is the home on a permanent foundation? If so, it may have been changed from personal property to real property at one time. The state of South Carolina allows this under the following circumstances: "...the manufactured home is installed in accordance with the state required installation standards, with wheels, axles, and towing hitch removed, and with the owner of the home having an intention that the manufactured home becomes an improvement to the real property whereon it is situated as evidenced by the filing of the [required] affidavits..."
If someone is buying a used mobile home, that person must get a title and the previous owner of the Manufactured Home must have signed that title over. If this title does not have the Bill of Sale on the back of the document, a Bill of Sale must also be submitted. The lien must be released or the lien holder must consent to transfer the lien to the new owner.
Therefore, if you don't presently have a title, then you are going to have to apply for one through the DMV. To do this you will have to provide the following:
Completed Form 400, Application for Certificate of Title/Registration
A title fee of $15.00
A stamped, clocked copy of the Manufactured Homes Severance affidavit, which has been filed in the register of deeds or clerk of courts office in the county where the mobile or manufactured home will be located.
The Form 400 must reflect any liens in the order of their priority that are listed on the Manufactured Home Severance Affidavit.
An Affidavit of Security Interest of Record executed by a licensed South Carolina Attorney identifying in the order of the priority any secured party having a security interest on the real property must be included with the Manufactured Home Severance Affidavit.
A copy of the Form 400 along with the Manufactured Home Severance must also be filed in the office of the register of deeds or the clerk of court in the county where the mobile or manufactured home was formerly located.
Sounds like a pain to do I know but unfortunately, that's good old South Carolina law. Call customer service at the DMV at this number (803)896-5000 and they will be glad to help you through this process.
