Subject: Seller Funds not at Title Company

Question
My loan was to close (per the contract) on the 17th of March.  The seller did not receive the payoffs for the mortgages until Thursday of last week.  The seller also has not yet sent the funds to close to the title company.  The realtors put me in a residential lease for -0- per month until the loan closes.  To date, funds for the closing have not been sent, and the realtors are not responding to find out where the sellers funds are.

What are my options at this point?  What if the seller doesn't send the correct funds?  I have moved into the house...should I be worried?

Answer
I am shocked they let you move into the house.  Anytime, people do not respond that is not a good thing.  Yes, I would be worried.  The house may be getting foreclosed on at any moment.  Sounds like the seller does not have the money. You must have bought it for less than he owed.  I would bet he is not making payments but I do not know that for sure.  I would be concerned.  You may get evicted if the house goes into foreclosure.
