Subject: Title company choice

Question
Who has the right to chose the title company? Buyer or Seller? Can you tell me if we have any type of law on that issue? So many agents put into MLS to use "ABC Title" at 123 Easy Street.

Answer
Great question with a hard answer.  This question has been asked many times in many ways.  The seller normally pays so his agent will try to choose.    However, since it is for the buyers sake many buyers feel they should choose.  Ultimately, the person paying for the title insurance can choose the title company.  It is not required that the seller pay so if the buyer wanted to pay then he could choose the company.  However, it is all negotiable.
