Subject: Deed of Trust

Question
My husband and I purchased (re-finaced) his previous marital home and my name is on the Deed of Trust. We are now divorcing, do I have any claim on the home? If not, why not?

Answer
Cynthia,

I'm assuming both you and your husband lived in the home while you were married.

Texas is a community property state.  In order for the home to be sold, both parties must sign the deed.

If the circumstances are different than this, please let me know.
