Subject: Earnest Money Contract

Question
It has been over three days and the broker has not responded to an earnest money contract....the contract is on a foreclosed home that is held by a bank in Ca. and we live in Texas...What do we?

Answer
Jo,

In Texas the sellers not required to acknowledge or respond to an offer.  In the case of a foreclosed home, the mortgage company often holds offers for some time in hopes of receiving a better offer.

If you are tired of waiting for a response, have your agent send a letter to the seller's agent retracting your offer.  If you want to wait it out, have your agent call them and fax them until he can get an answer.

Good luck.
